WARRANTIES

SABRE is the guarantor of the conformity of the Items sold by the online Shop. As such, any claim in respect of the legal warranty of conformity (provided for in Articles L. 217-4 et seq. of the Consumer Code or the warranty against defects in the item sold within the meaning of Articles 1641 et seq. of the Civil Code) must be addressed to SABRE - 4 allée des Vergers - 78240 Aigremont - France.

SABRE is liable for any lack of conformity of the goods to the contract under the conditions of Article L. 217-4 et seq. of the Consumer Code and for hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

The warranty for any item sold by SABRE through its online store is 24 months from the effective delivery date of the goods.

Excluded from the warranty are products or services that have been modified, repaired, incorporated or added by the Customer or any other person not authorized by SABRE for said product or service.

A customer acting under the legal warranty of conformity :

  • has a period of two years from the delivery of the goods in which to act;
  • may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
  • is exempt from providing proof of the existence of the lack of conformity of the goods for six months following their delivery.

The legal warranty of conformity is applicable irrespective of any commercial warranty granted.

The customer may implement the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Legal Warranties

All Products sold on the SABRE Website benefit from the legal warranty of conformity (Articles L217-1 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code), allowing you to return defective or non-conforming Products that have been delivered.

Legal warranty of conformity

You have a period of two years from the delivery of the Product to act pursuant to the legal warranty of conformity.

In this case, you will be able to choose between the repair or replacement of the Product, subject to the cost conditions provided for in Article L217-9 of the Consumer Code.

For contracts concluded on or after 18 March 2016, you are exempt from providing proof of the existence of the Product's lack of conformity in the twenty-four (24) months following the delivery of the Product. For contracts previously entered into, the default is assumed for six (6) months.

SABRE undertakes, to the extent reasonable and possible :

  • either to replace the Product with an identical product (within the limit of available stocks);
  • or to exchange the Product with a product of equivalent quality and price (within the limit of available stocks);
  • or to refund the price of the Product within 30 days following the exercise of the legal warranty of conformity, if replacement with an identical or equivalent Product proves impossible

Legal warranty against hidden defects

In addition, you may decide to implement the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, you may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

You may invoke the warranty against hidden defects where :

  • the fault or defect prevents you from making normal use of the Product;
  • at the time of purchase, you could not detect the fault or defect in the Product;
  • the fault or defect is not the result of improper use of the product;
  • you must act within two years of the day on which you discovered the defect to benefit from this warranty.

You may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

- Article 1641 of the Civil Code: The seller is bound to a warranty against hidden defects in the thing sold which make it unfit for its intended use, or that so impair its use that the buyer would not have bought it, or would only have given a lesser price, if he had known of the defects.

- Article 1648 1st paragraph of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

To exercise the legal warranties, please contact SABRE (see Article 11 of these General Terms and Conditions of Sale). In any event, SABRE's liability may not exceed the value of the Product(s) purchased.

The warranties do not cover defects resulting from improper handling, such as misuse or repair.
